These Terms govern the hosting services provided by Virtual Minds Hub Enterprise (“we”, “us”), trading as Vemhost, to you (“you”, “the customer”). By ordering or using our services you agree to them, together with our Acceptable Use Policy and Privacy Policy.
1. Your account
You must give accurate contact details and keep them current. You are responsible for everything done through your account, including by anyone you give access to. Keep your passwords confidential and tell us promptly if you believe your account has been compromised.
2. Fees and renewals
Services are billed in advance for the period shown at checkout. Invoices are issued before the renewal date and must be paid by that date. If payment is not received we may suspend the service, and we may delete the account and its data 2 days after suspension. Domain registrations are governed additionally by the registry’s own rules and are generally non-refundable once registered.
3. Refunds
You may cancel a new hosting service within 2 days of first payment for a full refund. After that, fees are non-refundable, except where required by law. Domain registrations, transfers and renewals are excluded.
4. Acceptable use
Your use of our services must comply with our Acceptable Use Policy. We may suspend a service immediately and without notice where it is causing active harm — for example sending spam, distributing malware, or consuming resources in a way that degrades service for other customers. Where the issue is less urgent, we will contact you first and give you a reasonable opportunity to fix it.
5. Backups
Daily backups are included with every plan except Shared Basic and Shared Spark, which include no backups from us. For plans with backups we take a daily backup and keep two days of history, with one additional copy stored off-site. These backups exist to help us recover from server-level failures. They are not a substitute for your own backups: we do not guarantee that a backup will exist, be complete, or be restorable for any particular file or point in time. You remain responsible for keeping your own copies of anything you cannot afford to lose. We will make reasonable efforts to assist with restore requests.
6. Availability
We aim to keep services available continuously, but we do not offer a guaranteed uptime level and no service credits apply. Interruptions may occur for maintenance, security response, hardware or network failure, or causes outside our control. Where maintenance is planned and likely to be disruptive, we will give advance notice where practical.
7. Your content
You retain ownership of the content you host. You are responsible for it being lawful and for holding the rights to use it. We do not routinely monitor customer content, but we may remove or disable access to material where we are legally required to, or where it breaches these Terms.
8. Suspension and termination
You may cancel at any time from your client area. We may suspend or terminate services for non-payment, for breach of these Terms or the Acceptable Use Policy, or where we are legally obliged to. On termination, you may request a copy of your data within 2 days of the account closing, after which it may be permanently deleted.
9. Liability
We provide the services with reasonable skill and care. To the extent permitted by law, we are not liable for loss of profits, loss of data, or indirect or consequential loss, and our total liability for any claim is limited to the fees you paid us for the affected service in the 3 months before the claim arose. Nothing here limits liability that cannot lawfully be limited.
10. Changes
We may update these Terms. Where a change materially affects you we will give at least 30 days’ notice by email or in your client area. Continuing to use the services after a change takes effect means you accept it.
11. Law and contact
